Terms and Conditions for Diamond Bar Genetix LLC.
1. Sale Format
This sale will utilize the “All Bids In – All Lots Sold” format. The sale will begin closing at 6:55 PM on the designated closing day. If there is no bidding on any lot within the final 5 minutes of the sale, the auction will close. If a bid is placed within the final 5 minutes, the clock will reset, and 5 additional minutes will be added to the countdown for all lots. This process will continue until no bids are placed for 5 consecutive minutes, at which point the sale will close. Buyers are encouraged to monitor their lots until the sale is officially closed.
2. Terms of Sale
All cattle and frozen genetics must be settled by check, credit card, or cash prior to load out or pickup of frozen genetics, unless payment arrangements have been pre-approved in writing by Diamond Bar Genetix LLC. Cattle and/or genetics will not be released until full payment is received. All sales are subject to these terms and conditions. Full payment is due within 14 days after the sale ends.
3. Breeding Interest
The Previous Owner reserves the right to retain breeding interest on all lots. Any embryos produced from females prior to their sale will grant the Previous Owner the rights to register the progeny. The Previous Owner also retains the right to conduct at least two successful IVF flushes on females offered in the sale.
4. Viewing
Live cattle lots will be available for viewing via Video and/or Pictures and by appointment in at respective location(s). Please contact our sale manager to schedule a viewing.
5. Export Requirements
Cattle or frozen genetics exported from the United States must comply with U.S. Export Administration Regulations. Purchasers bear all expenses for health tests required by foreign countries after the sale. Diamond Bar Genetix LLC. assumes no responsibility for cattle sold for exportation that do not pass the necessary health tests. All cattle are sold “As is” without warranties or guarantees.
6. Bidding
Each lot will be sold to the highest bidder. Diamond Bar Genetix LLC. reserves the right to settle any bidding disputes, and all decisions made by the sale manager shall be final. All bids will be kept confidential with guaranteed satisfaction.
7. Sight-Unseen Purchases
Purchasers who buy cattle sight-unseen do so at their own risk. Diamond Bar Genetix LLC. assumes no responsibility for sight-unseen purchases. Cattle are sold “As is” once payment is received, with no warranties or guarantees. If additional information is needed, please contact our sale manager.
8. Identification
Each animal is sold with its holding brand and individual private herd number. Buyers are responsible for verifying the accuracy of the identification information provided.
9. Health Information
All cattle offered in the sale are eligible for interstate shipment within the United States unless otherwise noted. Health tests for export are the responsibility of the buyer, with guarantees limited to 60 days.
10. Pickup and Feeding Policy
Buyers are required to arrange pickup of live cattle from respect sale location(s) within two weeks (14 Calendar Days) of the sale’s closing date. A One Week (7 Calendar Days) grace period will be provided for pickup, during which no fees will be charged. After this grace period, the buyer will be charged a daily boarding fee of $5 per head per day for cattle on pasture and $15 per head per day for cattle being dry-lotted until pick up. Diamond Bar Genetix LLC. will communicate with buyers to coordinate pickup and any necessary boarding arrangements. If cattle have not been picked up within 14 Days of purchase, Diamond Bar Genetix will repossess the cattle, the Deposit and Holding Fee(s) be forfeited and non-refundable.
11. Semen and Embryos
The storage location of frozen genetics (semen, embryos, etc.) will be specified in the description of each individual lot. Frozen genetics will be released to the buyer upon full payment. Buyer is responsible for Shipping Costs & arranging shipper tank and return label.
12. Cattle Loadout
The buyer is responsible for coordination of all shipping and transportation arrangements at their cost. Cattle can be loaded out after the payment has been received and cleared. Diamond Bar Genetix LLC. will assist with coordinating loadout but assumes no responsibility for shipping.
